Kathleen L. Daerr-Bannon, Esquire


ADR Services

Ms. Daerr-Bannon is a sole practitioner in Philadelphia, Pennsylvania with a civil litigation practice and major focus on alternative dispute resolution.

She has mediated personal injury and commercial matters, including Manville Trust Asbestos litigation and Piper Aircraft mediation. For several years, she served as a Dalkon Shield arbitrator and also served as a public facilitator for the National Silicone Breast Implant Litigation Revised Settlement Program. A certified mediator (previously) and current arbitrator for the United States District Court of the Eastern District of Pennsylvania and Judge Pro Tempore for the Court of Common Pleas of Philadelphia, she frequently serves as neutral in State and Federal Courts. In addition, Ms. Daerr-Bannon is a certified mediator for EEOC and for the USPS mediation program, REDRESS, in employment matters, and currently serves on national neutral panels for federal court class action claims in the Smith Barney DRP and the Merrill Lynch CRP, as well as serving in employment and commercial cases for USAM of the Northeast, DRI of Philadelphia, AAA and securities cases for NASD. She chaired the first Merrill Lynch case to be heard and served on the first public case as well as presiding over public viewing of class-wide evidence in New York City and in San Francisco.

She was consulted in the design and implementation of a multi-step ADR employment program for a Fortune 500 company, which program is in operation presently.

A frequent course planner for the ADR Committee of the Philadelphia Bar Association, she has lectured for the Pennsylvania Bar Association, the Pennsylvania Trial Lawyers Association, and the Pennsylvania Bar Association in conjunction with the ABA and written numerous articles, including for Pennsylvania Law Weekly. She is co-planner for PBI for the annual statwide ADR Institute which has been held in Philadelphia in 2005 and 2006 and most recently in Philadelphia and in Pittsburgh in March, 2007.

She has served several years as a co-chair of the ADR Committee of the Philadelphia Bar Association and for several years as a co-chair of the ADR Committee of the Pennsylvania Bar Association.
Ms. Daerr-Bannon received recognition by Jack Foltz and Bennett G. Picker for her invaluable assistance in the preparation of their chapter on alternative dispute resolution in Successful Partnering Between Inside and Outside Counsel, Robert L. Haig, Editor-in-Chief (ACCA & West Group, 2000). She is the author of Cause of Action to Enforce Arbitration in Employment Disputes, 15 Causes of Action 2d 215, Cause of Action for Disability Insurance Claim under ERISA, 29 U.S.C.A. 1001 et seq., Post-Firestone, 16 Causes of Action 2d 357, Cause of Action for Negligence or Malpractice of Expert Witness, 17 Causes of Action 2d 263, Cause of Action for Spoliation of Evidence, 19 Causes of Action 2d 249, and Cause of Action to Enforce Preinvention Assignment Agreements, 20 Causes of Action 2d 269.

Ms. Daerr-Bannon received her B.A. from Swarthmore College and J.D. from Temple University School of Law. She teaches Legal Studies in the Fox School of Business and Management, Temple University, and has taught EMBA students at Temple University Japan in Tokyo.
